1. Scope of Services

Fingerprint In Colombia provides specialized administrative facilitation, 100% digital LiveScan biometric processing, U.S. FBI and Canadian RCMP background check channeling support, U.S. Department of State and Global Affairs Canada federal apostilles (via Tu Apostilla), and certified Spanish translations (Traducciones Oficiales via Idiomatic USA).

2. Processing Timelines & Federal Agency Disclaimers

Estimated service turnarounds are provided as operational targets based on current federal channeler response times:

• U.S. FBI All-Inclusive Package: Turnaround is approximately 20 CALENDAR days total (including electronic LiveScan capture, U.S. Department of State Federal Apostille in Washington D.C., and certified Spanish translation).
• Canadian RCMP Package: Turnaround is 5 to 7 weeks total via our proprietary digital fingerprint scanning workflow (including Global Affairs Canada Apostille in Ottawa and certified translation).
• U.S. State Apostille Track: 2 to 12 days depending on the issuing Secretary of State jurisdiction.

Government Force Majeure & Third-Party Actions: Federal bodies (U.S. Department of State, Global Affairs Canada, FBI, RCMP, or Colombian Cancillería) operate independently. Fingerprint In Colombia is not responsible for unannounced government office closures, system maintenance, or security delays initiated directly by governmental authorities.

3. Client Responsibilities & Expiration Rules

• Non-U.S. Citizens Requesting FBI Checks: Must provide verified proof of past legal stay in the United States (such as a Green Card copy, U.S. Visa, or I-94 arrival record). U.S. citizens are exempt.
• FBI Download Link Expiration: FBI electronic report download links permanently expire 30 days after issuance. The client is responsible for downloading and backing up the digital PDF immediately upon notification.
• Biometric Quality & Worn Ridges: Real-time LiveScan hardware validates biometric clarity on site. If an applicant has severely worn ridges and receives consecutive federal biometric rejections, we transition the order to an official federal name-based search fallback.

4. Acceptability Guarantee for Colombian Visas

All federal apostilles and certified Spanish translations provided by Fingerprint In Colombia strictly comply with Hague Apostille Convention standards and Ministry of Foreign Affairs (Cancillería) and Migración Colombia requirements for Digital Nomad (V), Marriage/Partner (M), Pensionado, and Resident (R) visa applications.

5. Pricing, Right of Withdrawal & Refund Policy (Ley 1480 de 2011)

In accordance with Article 47 of Colombia’s Consumer Protection Statute (Ley 1480 de 2011 / Derecho de Retracto):

• Right of Withdrawal: Consumers generally possess 5 business days to withdraw from a purchase. However, under Article 47 (Exceptions to Right of Withdrawal), the right of withdrawal does not apply once the execution of custom services or personalized processing has commenced with your explicit authorization.
• Service Execution Threshold: Once your biometrics have been captured and transmitted to federal databases, or non-refundable government processing fees remitted to federal agencies, orders cannot be canceled or refunded.
• Administrative Re-processing: If an order cannot be processed due to an operational error on our part, Fingerprint In Colombia will re-execute the service at zero additional cost or issue a complete refund.

6. Privacy & Habeas Data Compliance

All client data and biometric information collected during service execution is processed under strict compliance with Colombian Statutory Law 1581 of 2012. You may exercise your Habeas Data rights (Access, Rectification, Cancellation, and Opposition) or direct data protection inquiries to our designated Data Protection Officer at [email protected].

7. Limitation of Liability

Fingerprint In Colombia and its operating entity, Borderless Business LLC, shall not be liable for visa refusals or scheduling delays resulting from third-party immigration decisions, client misrepresentation, or client failure to submit background check packages within Colombian statutory validity windows (typically 90 to 180 days from document issuance date).
